Most of these terms are expected and understood in our industry, but sometimes they get overlooked in e-mail and conversation. Below is my list of terms which stipulate my rate, overtime, transportation, cancellation/rescheduling fee, and understanding of on-set protocol.
These terms are listed here as protection for me, as well as protection for you, and that we are both in agreement and there is no confusion later. However, these terms are negotiable from job-to-job.

For the purpose of this agreement, “client” is referring to whomever is producing the shoot.
- “Freelance isn’t free law” mandates strict rules for all freelancers in NYC unless the contract is provided separately for specific terms such as NET 30, double damage, and more.
- Upon receipt of invoice, payment is to be made by bank transfer within 30 days of invoice date. If the Client defaults on payment, a late payment fee of 20% of the outstanding amount will be compounded and charged every 14 calendar days from the 31st calendar day after the date of the Photographer’s invoice until payment is received in full.
- More than $800 of payments MUST provide a contract based on the law.
- Any payment not received within 30 days of the invoice date (NET 30) or by the specific date stipulated in the contract shall be subject to a late fee of 2% of the total outstanding balance per month, calculated from the first day following the due date until the payment is received in full.
- Clients or hiring parties MUST provide all information for invoice and contract including phone number, address, email address, and more in order to create a contract.
- Rate @ 10hrs, overtime (OT): 10% of total payment per hour.
- Over 15 min is a half hour, over a half hour is an hour, for the 1st hour of OT. After the first hour of OT, anytime over will be charged by the hour.
- Kit is rented per shoot day.
- After confirmation, a cancellation fee will be awarded to any shoot up to 48hrs of date of shoot at a fee of 50% of agreed rate up to 24hrs before shoot date, and a fee of 100% of agreed rate 24hrs and below, for the duration of all confirmed dates, if shoot is cancelled. This does not include weekends, meaning, if a job for Monday cancels Thursday, the 48hr fee activates. The same goes for Friday - Sunday for the 24hr fee.
- If the shoot dates of a confirmed booking are rescheduled and I am unable to do the new dates, then cancellation fees will apply.
- In the event of cancellation or postponement for any cause, client shall pay all expenses incurred up until the time of cancellation.
